Terms of service

The agreement
These terms are a contract between you and Volanea ("we", "us") governing your use of volanea.com, app.volanea.com, and the Volanea API (together, "the service"). Creating an account means you accept them. If you're accepting on behalf of a company, you confirm you have the authority to bind it.
The service
Volanea is an email platform: transactional sending, marketing campaigns, automation workflows, and contact management, available through a dashboard and an API. We may add, change, or retire features; if a change removes something material you rely on, we'll give reasonable notice.
Your account
Keep your credentials and API keys secret — activity under your keys is your responsibility. Secret keys belong on servers, never in client-side code. Tell us immediately if you believe a key is compromised; you can rotate keys yourself in settings at any time.
Acceptable use — the anti-spam rules
This section is the heart of the agreement, because one bad sender can hurt every sender. You agree to:
Send only to people who opted in. Purchased, rented, or scraped lists are prohibited — no exceptions. Every marketing recipient must have given you their address knowingly.
Honor unsubscribes instantly. The platform enforces suppression automatically; circumventing it is a violation.
Be who you say you are. No forged headers, no impersonation, no phishing, no malware, no deceptive subject lines. Comply with the laws that apply to your sending (CAN-SPAM, GDPR, CASL, and their equivalents).
We enforce this actively: automated systems monitor bounce and complaint rates and scan content for phishing. Crossing abuse thresholds can throttle, pause, or permanently disable a project — without prior notice where the integrity of the platform requires it. That protection of shared sender reputation is a feature, and by using the service you're agreeing to be on the protected side of it.
Plans and billing
The free plan includes 1,000 email credits a month and stops sending at the cap. The pay-as-you-go plan is billed post-paid — a flat monthly fee plus per-credit usage beyond the free allowance — invoiced at the end of each month and payable via Razorpay in INR. Prices are listed on the pricing page; if they change, existing customers get at least 30 days' notice. Unpaid invoices may lead to suspension after reasonable reminders. You can switch plans or stop using the service at any time; there's no lock-in.
Your content and data
Everything you upload or create — templates, contact lists, message content — remains yours. You grant us only the license needed to operate the service (store it, render it, deliver it). We claim no other rights. You're responsible for having the right to use the content and contact data you bring.
Availability and disclaimers
We work hard to keep the service fast and available — queues are durable, infrastructure is monitored, and backups run nightly — but the service is provided "as is", without warranties or an uptime SLA. Email delivery ultimately depends on receiving mail servers we don't control; no provider can guarantee inbox placement, and we don't either.
Limitation of liability
To the maximum extent the law allows, our total liability for any claim arising from the service is capped at the amount you paid us in the three months before the claim. We're not liable for indirect, incidental, or consequential damages — including lost profits or lost data — even if advised of the possibility.
Termination
You can delete your account at any time. We can suspend or terminate accounts that violate these terms, create legal risk, or remain unpaid after reminders. On termination we'll make your data available for export for a reasonable period unless the termination was for abuse.
Governing law and changes
These terms are governed by the laws of India. If we change them materially, we'll note it here and email account owners before the change takes effect; continued use after that is acceptance. Questions: support@volanea.com.
